1. Introduction

Sharif Fitness Inc. (“we,” “our,” “us”) is committed to providing a clear understanding of the terms and policies that apply to our services. By accessing or using our services, you agree to be bound by the following terms and policies.

2. Policies & Procedures

This section outlines our commitment to providing a safe, respectful, and supportive environment for all members and staff. Our policies are designed to ensure the highest standards of conduct and service, fostering a community where everyone can thrive in their fitness journey.

By clearly defining our procedures, we aim to create transparency and understanding, allowing our members to make informed decisions and engage fully with our services. We encourage all members to familiarize themselves with these policies to enhance their experience at our facility. Thank you for being a part of the Sharif Fitness family!

Cancellation Policy
  • Personal Training: Once session is confirmed, 24-hour notice of cancellation/reschedule for appointment is required. Sessions missed without proper notice will be subject to a $45 Cancellation/No Show fee. Session will not be deducted, only the Cancellation/No Show fee will apply. This policy is aimed to improve efficiency for all clients.
  • Classes: A minimum of 3-hours in advance is required for class cancellation/rescheduling. In the event that you “Late Cancel” a class or “No Show” there will be a $15 fee charged. Fees will be charged at the end of each month. Please make sure you remove yourself from the class/waitlist if you no longer wish to have a spot in class. This policy is aimed at improving efficiency and fairness for all members. Thank you for your support and understanding.
Sickness Policy and Procedure
  • Clients/Participants/Members are kindly requested to STAY HOME and to NOT ATTEND any Personal Training Sessions or Group Classes while sick with either the common cold, COVID-19 or any other communicable illnesses. At Sharif Fitness, your health is our top priority. This is the best way to ensure the health & safety of all our valued members. Clients/Participants/Members attending sessions/classes while sick will be sent home, and PT Session/class attendance will be consumed. A minimum of 3-days of rest is mandatory after being sick before clients are eligible to return to their regular schedule. Thank you for your understanding and cooperation.
Personal Training
  • Sessions are NOT transferable nor refundable. 
  • Billings are subject to the Personal Training Agreement’s Cancellation Policy. Requested 30 days in advance; 50% remaining balance is due to cancel Agreement in it’s entirety. Please refer to the Personal Training Agreement for more information. 
  • Billings are automatically withdrawn from credit card on file on specified date. An NSF (non-sufficient funds) charge of CAD $45.00 will be applied for declined transactions after a 5-day period. Overdue accounts over 30-days will be automatically frozen with restricted access.
  • All Personal Training Sessions have expiration dates. Please refer to the Personal Training Agreement for more information.
Fitness Group Classes
  • Visit Limit: Members can attend a maximum of 2 classes per day. There are no make-up classes for missed group fitness classes by participant and for statutory holidays. Classes are ongoing. 
  • Memberships can be place on HOLD for a minimum of 30 days and a maximum of 90 days per calendar year with 30-Days advance notice.
  • Billings are automatically withdrawn from credit card on file on specified date. An NSF (non-sufficient funds) charge of CAD $45.00 will be applied for declined transactions after a 5-day period. Overdue accounts over 30-days will be automatically frozen with restricted access.
  • Memberships automatically renew upon contract’s term completion, unless cancelled prior to term completion. Please refer to the Fitness Class Agreement for more information.
3. External Providers

We may collaborate with external providers such as Groupon and ClassPass to offer promotional deals and access to our group fitness classes and personal training sessions. These platforms facilitate transactions and help us reach a wider audience. Please note that when you interact with these providers, they may collect personal information as per their own privacy policies. We encourage you to review their privacy and policy practices to understand how your information may be used and shared.

Groupon Merchant
  • Vouchers: All payments for services purchased through Groupon are processed directly by Groupon. At Sharif Fitness Inc., we only redeem vouchers issued by Groupon. For any inquiries regarding refunds or voucher issues, customers must contact Groupon directly, as they operate independently and we have no control over their policies or procedures.
  • Voucher Validity: Groupon vouchers are limited to one use per client and are valid only for new members. This introductory offer is designed to provide potential clients with a discounted trial of our services, allowing them to experience our business before committing to our regular pricing. Two (2) additional vouchers can be purchased as gifts, excluding original member.
  • Tax Collection on Vouchers: Please note that while Groupon does not charge tax on the voucher purchase amount, Sharif Fitness Inc. is required by law to collect applicable taxes on the services redeemed with these vouchers. Any applicable taxes will be calculated and added at the time of service redemption.
  • Voucher Redemption: Vouchers can be redeemed either online or in person at Sharif Fitness Inc. Customers may email us their voucher code to book their appointment or bring their voucher with them on their first visit. We look forward to welcoming you!
ClassPass
  • Bookings: All ClassPass bookings are handled directly through the ClassPass platform. Sharif Fitness Inc. does not manage or process ClassPass reservations. For any inquiries regarding ClassPass bookings, please contact ClassPass customer support directly.
  • Visit Limit: Sharif Fitness Inc. accepts new customers to utilize a maximum of one (1) ClassPass visit. This introductory offer is provided at a discounted price, giving potential clients the opportunity to experience our classes before deciding to join as regular members at our standard pricing.

NOTE: Sharif Fitness Inc. does not profit from the services offered through Groupon or ClassPass. Our primary goal is to use these platforms for marketing purposes with the aim to attract new members and provide them with the opportunity to experience our services with the purpose to convert them into regular members.

4. Code of Conduct

The following conduct or behavior is not permitted at any time within any Sharif Fitness premises or group excursions:

1. Disorderly behavior of any kind, including excessive noise, vulgar, cursing or otherwise causing disruption to the peace and order of the class. Be humble and respectful; treat others how you would want to be treated.
2. Absolutely no physical/verbal fighting, and sexual activities will be tolerated within the vicinity of Sharif Fitness.
3. Harassment of other Sharif Fitness guests or staff, either verbally or physically is highly prohibited. This may include verbal abuse, use of profanity or other abusive language, intimidations, staring at or following another person within the facility, sexual harassment or harassment on the account of race, religion, ethnic background, gender or sexual orientation.
4. Refrain from training without proper protection. This includes gloves while hitting the bags or pads; and all safety equipment must be worn while exercising and/or sparring. (gloves, braces, mouth guard, shin guards, cup, head gear, hand wraps and 14/16 oz gloves)
5. Being reckless around hazardous areas (i.e. mirrors). Sparring near the mirrors, walls, poles, etc. is not allowed.
6. Vandalizing or defacing materials or property including equipment, furniture, walls or any other aspect of Sharif Fitness is prohibited. Return all equipment once done (i.e. rental mats, gloves, shin guards, weights, pads, skipping ropes, etc. as applicable).
7. Removing materials, equipment or property from the building without authorization is prohibited.
8. Being unhygienic before, during, and/or after training. Clean and wash all personal and gym equipment with a proper disinfectant (i.e. Gloves, shin guards, head gear, weights, etc.)
9. Failure to clean up after oneself within any part of the facility, this includes re-racking weights when finishing a set in the free weights area may result in a penalty.
10. Possession of a camera phone in any of the locker room areas is prohibited.
11. Indecent exposure, voyeurism, exhibitionism, or other lewd and lascivious acts is prohibited.
12. Training while being sick is highly ill-advised (We encourage optimal health for ALL the members).
13. Leaving trash in the training studios is prohibited.
14. Leaving personal property in the facility unattended. All property must be stored in a locker. Property left unattended will be confiscated. Sharif Fitness Incorporated is not held responsible for any personal items and valuable belongings that goes missing; please place items in locker or secure visible place. Locker use are for gym hours only; any locks that are left overnight without proper registration will be cut off.
15. Bringing firearms or any other deadly weapons into Sharif Fitness is extremely prohibited.
16. Bringing a bicycle into the facility must be put in the back of the facility only. No bicycles are to be left near any of the entrances.
17. No rollerblades, skateboards, incline skates, scooters or any other sports equipment that may cause damage to our floors are allowed use in the facility.
18. No sleeping at the gym.
19. Possessing or consuming alcohol or illegal drugs or being under the influence of alcohol or illegal drugs while at Sharif Fitness is prohibited.
20. No smoking tobacco products including any type of electronic cigarettes, hookah, etc.
21. CrossFit style training is prohibited due to safety issues.
22. Selling products or services, soliciting for personal gain; or approaching guests for the purpose of obtaining signatures for petitions within the building is prohibited.
23. Posting or distributing unauthorized material or literature is prohibited. Approval must be obtained in advanced from management before proceeding.
24. Abandonment of individuals, both adults and children, who are unable to take care of themselves is prohibited. A responsible guardian must attend to children under 16.
25. Membership must be paid on time every month according to billing date.
26. No overnight parking.

5. Privacy Policy

  • Providing Services: To process your membership, manage class bookings, and deliver the services you request.

  • Communication: To send you updates about your account, classes, and other services, as well as promotional offers that may be of interest to you.

  • Improving Services: To understand how you use our services, allowing us to enhance your experience and develop new features.

  • Compliance: To comply with legal obligations, including fraud prevention, data protection, and health and safety requirements.

Sharing Your Data

We do not sell your personal information to third parties. However, we may share your information in the following situations:

  • Service Providers: We may share your information with trusted third-party service providers who assist us in operating our business, such as payment processors, email services, and IT support.

  • Legal Requirements: We may disclose your information if required by law, regulation, or legal process, or to protect the rights, property, or safety of Sharif Fitness Inc., our employees, or clients.

  • Business Transfers: In the event of a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred to the new owner.

Securing Your Data

We take the security of your personal information seriously and implement appropriate measures to protect it from unauthorized access, disclosure, alteration, or destruction. However, please note that no data transmission over the internet is 100% secure, and we cannot guarantee absolute security.

  • Correction: You can ask us to correct any inaccurate or incomplete information.

  • Deletion: You can request that we delete your personal information, subject to certain legal obligations.
